Ein Sanierungsinstrument fÃ"r polnische Insolvenzverfahren?
Eignet sich die deutsche Insolvenzgeldvorfinanzierung als Denkmodell fur die Entwicklung einer Sanierungshilfe fur zahlungsunfahige polnische Unternehmen? Die Autorin untersucht diese Fragestellung, indem sie sich mit den einschlagigen Rechtsgebieten, dem polnischen Insolvenz-, Arbeits- und Zivilrecht, dem deutschen Insolvenzgeldrecht sowie dem flankierenden Europarecht beschaftigt. Dabei kommt sie zu dem Ergebnis, dass das polnische Rechtsinstitut der Subrogation in Gestalt der Konversion (konwersja dlugu), geregelt in Art. 518 § 1 Nr. 3 des polnischen Zivilgesetzbuchs, fur die Vorfinanzierung von Arbeitsentgelten in der Insolvenz des Arbeitgebers als Sanierungshilfe in bestimmten Insolvenzfallen eingesetzt werden kann. The author explores this issue by dealing with the relevant areas of law, Polish insolvency, labour and civil law, the German Insolvency Code and the flanking European law. She concludes that the Polish legal institution of subrogation in the form of conversion (konwersja dlugu), regulated in Article 518 Section 1 (3) of the Polish Civil Code, can be applied to the pre-financing of wages when employers become insolvent to bail out certain insolvency cases.
