The Transformation of the Fourteenth Amendment, Second Edition
Published in 1977, this book launched a national debate on the proper role of American courts that continues to the present. This edition includes the original text in its entirety, to which the author has added extensive supplementary discourses that assess and rebut the responses of his critics.
It is Berger's theory that the United States Supreme Court has embarked on "a continuing revision of the Constitution, under the guise of interpretation", thereby subverting America's democratic institutions and wreaking havoc upon Americans' social and political lives.
